If he resigned, why would he be getting any payout ...

A former Toowoomba local government chief executive says the resignation of Phil Spencer from the top job should not be a significant cost to ratepayers on Queensland's Darling Downs.

The Toowoomba Regional Council chief resigned this week, and there has been media speculation he had a difficult relationship with elected representatives.

A council spokeswoman yesterday said the "financial arrangement" will remain confidential because it is part of the terms and conditions of Mr Spencer's contract.

Former Jondaryan chief and council by-election candidate Noel Cass says he does not expect there would be any payout.

"It was a resignation, it wasn't a termination and if it's a resignation to be honest with you there wouldn't be under any contract," Mr Cass said.

"A resignation wouldn't attract a remuneration package as far as I know."

I am infuriated at the flouting of the rules in this matter. The ordinary employee knows full well that if he resigns suddenly he forfeits his entitlements, to what extent I don't know. What happened to one months' notice?
The same thing happened with Peter Beattie> Suddenly the Premier of this State is gone with a full payout and next thing we hear he has a plum job in the States. It seems as if the public purse is a bottomless trough for people who earn very large salaries - but not the ordinary employee. Maybe the Unions could look into this but of course they look after their Labor mates.

In regard to the Toowomba Regional Council it is one thing to think you can do the job but another to actually be able to understand the job. You could not wait to appoint Phil Spencer, even though you did not have to do it immediately. Now you see the consequences. The public will be livid that $500,000 of their rates will have to be used to pay out this person who signed a Contract then resigned after six months. It does not seem right to me and it seems as if the rules should be changed so that someone cannot suddenly resign unless they are gravely ill and then collect full entitlemens. It is morally wrong. $500,00 takes a long time for the ordinary ratepayers to raise and it should not be paid out for nothing. It will encourage other people with no moral fibre to take the money and run. The public confidence in this Council has been eroded and the public are not buying the story that "the Mayor did not gag his fellow Councillors"
